Terms of service
These terms govern the relationship between you and the Masar agency when you order any of our services. We recommend reading them before approving a quote, because approving it means you accept them.

01Scope of service
The scope of each project is set out in writing in the approved quote: the number of pages, the features required, the deliverables and the timeline. Anything not mentioned in the quote is out of scope.
Requests to expand after approval — such as adding pages, systems or languages — are priced separately, and are only carried out once you approve the new price and timeline in writing.
02Pricing and payment
The prices published on the site are starting prices, reflecting the minimum for each plan; the final price is set once we understand your requirements.
- A first payment of 50% when you approve the quote, which is required before work starts.
- A second payment of 50% on delivery, before the site is published on its final domain.
- Prices include the domain and hosting for the first year, and don’t include renewal after that or third-party subscriptions.
- The first payment is non-refundable once the design stage has started, because it covers work time set aside for you.
03Client responsibilities
The timeline depends on your cooperation. We need you to provide the text content, images, brand identity and any technical access required, and to respond to approval requests within a reasonable time.
Any delay in providing these materials moves the delivery date back by the same amount, and doesn’t count as a breach on our part.
04Revisions
Each project includes one round of revisions during the build stage. A revision round is a single, consolidated set of feedback — you gather all your requested changes into one list, and we implement them together.
A round is complete once those changes are implemented and delivered for your review. Refining the same changes is still included; any new feedback introduced afterward begins a new round.
Additional revision rounds are billed at the hourly rate published at the time.
05Delivery dates
The timelines given in the plans and in the quote are estimates in working days, counted from the day we receive the first payment and all the materials.
We are not responsible for delays caused by things outside our control, such as outages at infrastructure providers or force majeure.
06Intellectual property
Ownership of the delivered designs and code passes to you in full once everything owed has been paid. Until then, the deliverables remain the property of Masar.
The tools, internal components and general frameworks we use across projects remain ours, or their original owners’, under their licences.
Unless you request otherwise in writing, you allow Masar to display the completed website and selected screenshots as part of its portfolio and marketing materials.
07Support and maintenance
Every project includes 30 days of free support after launch, covering software bugs and display and performance issues related to what we delivered.
Free support doesn’t cover new features, design changes, content updates, or fixing faults caused by changes someone else made to the code or settings.
After that period, optional monthly maintenance plans are available under a separate contract.
08Hosting and third-party services
The site is deployed on Cloudflare’s infrastructure, and the service is subject to the provider’s terms and policies. We help you set it up and connect it, but we are not responsible for outages or policy changes at any third party.
09Limitation of liability
We provide our services with the usual professional care, but we don’t guarantee specific business results, such as a particular search ranking or volume of sales.
In every case, our liability is limited to the amount actually paid for the project in dispute.
10Ending the contract
Either party may end the contract by written notice. If you end it, the value of the work done up to the date of the notice is deducted from what you have paid, and any surplus is refunded.
11Governing law
These terms are governed by the laws of the State of Kuwait, whose courts have jurisdiction over any dispute arising from them.
